Consent Searches and Search Warrants

A: When a cop is trying to get permission to do a search, they gotta make sure that a supervisor gets brought to the scene for homes and the supervisor needs to make sure the permission is completely fair and not forced at all. If a car or something like that is completely and only used to store stuff, then it’s basically just another part of the house, and the cop needs the same permission to go into it.

The owner of the property should sign a form to make sure that the cop is allowed to come in, and obviously, the person giving permission has to actually be allowed to do that. The person giving permission also has to stay close to the cop so they can tell the cop to get out if they needs to. If the suspect was arrested, then the cop needs to make sure that the person knows their rights before signing their form. The cop should give the person signing the form a copy too, and also all the stuff they took. The investigator, should give a copy of the form in the file, and give the old form to the records division.
